Ms. Esha Acharya ... for the petitioner Mr. Debaki Nandan Maiti ... for the WBUHS Pursuant to the order passed on 04.11.2019 by Hon'ble Justice Subrata Talukdar, as His Lordship then was, I am told by the learned advocate for the West Bengal University of Health Sciences, being the respondent no. 2, that the petitioner got admitted in the college and is now pursuing his course and he is on his 4th year of studies.

I hold that there cannot be any looking back. The University filed one appeal which is kept pending for last 3 (three) years but there is no restraining order. The petitioner's career as a medical student cannot be jeopardized. He is pursuing his course in Calcutta Medical College. Therefore, the provisional admission taken by the student is now confirmed and he shall be treated as

a student who took admission normally in the said medical college.

In this matter no affidavit in opposition has been filed.

Learned advocate for the West Bengal University of Health Sciences submits that as appeal has been preferred, no affidavit has been filed and they have also filed the paper book. However, such type of matter where the future of a student is involved, this court cannot wait so that the student's future can be kept on tenterhooks.

Therefore, the writ application is allowed and the petitioner shall be treated as a regular student of the said college.
