There is a proceeding under the POCSO Act pending as against the petitioner.

Learned advocate for the petitioner refers to the injury report.

It appears from the injury report that the hymen of the victim stands raptured. It also appears from the records that an application for bail was rejected on April 27, 2021 by the learned Special Judge (under the POCSO Act)-cum Additional Sessions Judge, Mathabhanga, Cooch Behar.

In view of the medical report, we are not inclined to grant bail to the petitioner.

CRM 604 of 2021 is dismissed.
