The petitioner's prayer for transfer filed in the Utsashree portal has been rejected in May 2022 by the head of the institution on the ground of 'more than 10 per cent'.

Learned advocate for the petitioner submits, upon instruction that, presently the teachers' strength of the school has been augmented. Due to addition of several new teachers in the subject school, the 10% bar may not be applicable at this stage.

It appears that the petitioner is pressing her claim for transfer since 2022.

As the Utsashree portal is currently suspended, accordingly, leave is granted to the petitioner to file offline application seeking transfer disclosing ground(s) for the same.

In the event such an application is made, the same shall be considered by the head of the institution within a week from receipt of the same and thereafter forwarded to the District Inspector of Schools (S.E.) for taking a decision in the matter in accordance with law at the earliest but positively within a period of ninety days from the date of filing the application. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
