1. The petitioner herein prays for bail in connection with Dinhata Police Station Case No.218 of 2026 dated 10.04.2026 under Section 126(2)/117(2)/118(2)/109(1)/351(2)/3(5) of Bharatiya Nyaya Sanhita, 2023, pending before the Learned Additional Chief Judicial Magistrate, Dinhata.

2. On hearing the Learned Counsel for the petitioner and the Learned Counsel appearing for the State, and also on perusal of the materials in the case diary, it appears that the victim in the present case, has sustained injuries over scalp and back by way of the alleged assault with stick and knife in the present case.

3. From the injury report, it appears that the injury was inflicted at about 1:30 p.m., and on the same day at 2:30 p.m. the injured/victim was examined.

4. It has been noted in the injury report as "receipt of injury" is at 1:30 p.m. and this does not mean receipt of injury "report" as contended by the petitioner herein.

5. It appears that a co-accused has been granted bail by the trial court on 20.04.2026.

6. The petitioner herein has prayed for anticipatory bail.

7. Considering the case of injury and the weapon allegedly used, this Court is not inclined to grant anticipatory bail to the petitioner herein.

8. Prayer for anticipatory bail is thus rejected.

9. The application being CRM (A) 306 of 2026 is rejected.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
