IN THE HIGH COURT AT CALCUTTA

CIRCUIT BENCH OF CALCUTTA HIGH COURT AT JALPAIGURI WPA 1090 of 2022 Mamata Roy & Ors.

Vs.

The State of West Bengal & Ors.

Mr. Kalyan Kumar Chakraborty ......for the petitioners In spite of directions the respondents/State have not filed an affidavit-in-opposition.

Although learned counsel for the petitioner continued to argue the writ application for a considerable period of time, none appeared for the respondents.

The allegation of the writ petitioners is with regard to filing up of the vacancies in FPS dealership at Village Kumarpara, P.O. Bounbari, G.P -Domohoni-II, P.S and Block Maynaguri in the district of Jalpaiguri.

It is alleged that the concerned licence has already been issued in favour of one Susmita Biswas (Dey), the respondent no. 8. Allegedly the respondent submitted her application beyond time and resides outside Domohini II Gram Panchayet. She does not have proper space to

carry out the terms of the licence. She does not belong to the Rasbanshi caste to which 80-90 percent of the villagers belong. The licnece ought to have been granted to someone belonging to that caste.

This grievance of the writ petitioner was pointed out to the District Magistrate by a letter of the writ petitioners dated 2nd May, 2022. There has been no response to this letter.

I direct the District Magistrate, Jalpaiguri District to consider the representation made in the letter dated 2nd May, 2022 written by the writ petitioners to him, give a short hearing to them (one writ petitioner to be nominated by all), or their learned lawyer which may be of about half an hour only and to make a reasoned decision to be communicated to the writ petitioners' Advocate-on-record by 30th June, 2023.

This writ application is accordingly disposed of.
