Petitioner seeks anticipatory bail.
Learned Advocate appearing for the petitioner submits that the petitioner is the nephew of the husband of the deceased. He submits that, the brother-in-law of the deceased was granted anticipatory bail on April 28, 2021. The husband of the deceased was granted bail by the Court below. He, therefore, seeks anticipatory bail. Learned Advocate for the State submits on her usual fairness that, the name of the petitioner did not come up in course of investigation.
In such circumstances, since the husband of the deceased was granted bail and that, the brother-in-law of the deceased was granted anticipatory bail, and since the State is yet to find any material as against the petitioner, we are inclined to grant anticipatory bail to the petitioner.
In the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount, one of whom must be local, to the satisfaction of the arresting officer of the
concerned police station with conditions as laid down under Section 438(2) of the Code of Criminal Procedure and on further condition that, the petitioner shall meet the Investigating Officer once a week until further order.
CRM 610 of 2021, is disposed of accordingly.
