By order dated 01.12.2023 learned Tribunal had directed the respondent/railway authorities to take a decision with regard to the prayer of the applicant/wife for compassionate appointment and release of half of the death service benefits to her on account of death of her husband. This order has been impugned by the father and brother/sister of the deceased employee. We note that the order impugned has already been given effect to and respondent no. 4-senior Divisional Personal Officer has passed a reasoned order.

In view of the aforesaid development nothing remains to be decided in the writ petition.

3. Writ petition is, accordingly, dismissed.

It is open to the petitioners to challenge the order passed by respondent no. 4 in accordance with law, if so advised.

5. There will be no order as to costs.
