1. The revisional application has been preferred challenging orders dated 20.02.2026 & 09.06.2026 in Misc. Petition(P) Case No.11 of 2026 under Section 175(3) of the Bharatiya Nagarik Suraksha, 2023 passed by the Learned Additional Chief Judicial Magistrate, Dinhata, Coochbehar.

2. It appears that vide the impugned order dated 20.02.2026, the trial court was pleased to reject the petitioners application under Section 175(3) of the BNSS, for default for non appearance.

3. On hearing the Learned Counsels for the parties, including the State and in the interest of justice, the impugned orders are set aside.

4. The application under Section 175(3) of the BNSS is restored to its file and number.

5. Matter be listed for hearing before the trial court on 01.07.2026 and an opportunity of hearing be given to the petitioner herein. The trial court shall proceed with the case in accordance with law.

6. CRR 180 of 2026 stands disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with requisite formalities. (Shampa Dutt (Paul), J.)
