Learned counsel for the petitioner submits that long incarceration is the ground for moving this application.
Learned counsel appearing for the prosecution has produced before us the status report from which it appears that 16 witnesses out of 18 witnesses have been examined.
In view of substantial progress being made in the trial , we are not inclined to grant bail to the petitioner at this stage. The application for bail of the petitioner is rejected. CRM (DB) 280 of 2023 is accordingly, disposed of.
However, we request the learned Additional Sessions Judge, 1st Court at Siliguri to conclude the evidence of the remaining two witnesses preferably by 31st July, 2023 and shall not grant any adjournment to either of the parties, unless it is unavoidable.
Learned Registrar, Circuit Bench at Jalpaiguri, is directed to communicate this order to the learned Additional Sessions Judge, 1st Court at Siliguri for information and doing the needful.
The status report filed in court be kept with the record. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
