The petitioner seeks 'A' category scale of pay on and from the next date of conclusion of the training course. She claims to have received the said scale of pay on and from a later date.

It appears that instead of approaching the concerned authority, the petitioner has directly filed the writ petition before the Court seeking 'A' category scale of pay.

The petitioner ought to have approached the authority first prior to approaching the High Court for relief.

It has been brought to the notice of the Court that the issue in question as to whether higher scale would be paid on and from the next date of conclusion of the examination or from the date of declaration of the result of training has already been decided by the Court on 19th July, 2024 in WPA 16023 of 2024

The instant writ petition is disposed of by granting leave to the petitioner to file a comprehensive representation disclosing all facts and annexing the time table for appearing in the D.El.Ed. course. 6.

In the event such a representation is made along with supporting documents, the same shall be considered by the Chairman, DPSC, Jalpaiguri in line with the decision passed by the Hon'ble High Court in the aforesaid order.

A decision shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of submission of the representation. 8.

All arrears of the petitioner, if admitted, shall be positively disbursed within a period of twelve weeks thereafter.

The writ petition stands disposed of.

10.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
