The learned Counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the instance case.
The learned counsel for the State opposes the prayer for anticipatory bail and draws our attention to the statement of the minor recorded under Section 164 of the Code of Criminal Procedure.
Considering the materials available in the case diary and more particularly, the statement of the minor recorded under section 164 of the Code of Criminal Procedure directly implicating the petitioner, we are not inclined to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected. CRM (A) 243 of 2023 is, thus, disposed of.
