1. The petitioner herein prays for anticipatory bail apprehending arrest in connection with Dinhata Women Police Station Case No.28 of 2026 dated 15.03.2026 under Section 329(4)/303(2)/115(1)/351(1)/3(5) of the Bharatiya Nyaya Sanhita 2023 and read with Section 8 of the Protection of Children from Sexual Offences Act 2012 and corresponding to POCSO Case No.13 of 2026, pending before the Learned Special Court (POCSO)-CumAdditional District and Sessions Judge, Dinhata.

2. On hearing the Learned Counsel for the State who has placed the case diary, the nature of allegations and the

materials in the case diary including the statement of the alleged victim recorded under Section 183 Cr.P.C. of the BNSS, wherein the alleged victim has categorically made her statement before the Learned Magistrate and also keeping in mind the fact that the victim has refused medical examination, in the present case, this Court is inclined to grant anticipatory bail to the petitioner.

3. Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.5,000/- each with two sureties of Rs.2,500/- each, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioners shall meet the I.O. as and when required till submission of report in final form.

4. The prayer for anticipatory bail of the petitioners is allowed.

5. CRM(A) 342 of 2026 is thus, disposed of.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with requisite formalities.
