Learned advocate appearing for the petitioner submits that there is a title suit pending. The private respondents encroached upon land belonging to the petitioner.

The private respondents also demolished the structure belonging to the petitioner. The police are inactive. Learned advocate for the State submits that the complaint of the petitioner was inquired into. He submits that there is a Title Suit and an Appeal pending.

In the facts of the present case, there are disputes between the private parties with regard to an immovable property. There is a Title Suit pending. The police took steps on the complaint lodged by the petitioner.

In view of the pendency of the civil suit and since the disputes between the private parties are civil in nature, no further interference is called for by the writ court.

This order, however, will not prevent the private parties to avail of the remedies before the appropriate forum in accordance with law.

WPA 1083 of 2021 is disposed of accordingly.
