1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. By the present writ petition, the petitioner seeks for order or orders, direction or directions in the nature of Mandamus upon the respondents to restore the name of the petitioner in the electoral roll and also prays for expeditious hearing of the appeal being no.APS2501G050426534463.
3. The petitioner contends that the petitioner duly submitted Enumeration form on 6th November, 2025 in the SIR-2026 and attended the hearing before the Booth Level Officer (in short BLO) on 22nd January, 2026. However, in the final rolls of SIR2026 published on 28th February, 2026 the petitioner's name was shown 'under adjudication' in Serial No.886, Part No.49,
4-Coochbehar Dakshin Assembly Constituency. Hence this writ petition seeking for appropriate relief.
4. Mr. Akramul Hoque, the petitioner in person submits that he has filed an appeal against the order of Election Commission putting him 'under adjudication'
before the Appellate Tribunal being Appeal No.APS2501G050426534463.
He seeks direction for expeditious hearing of the appeal. To buttress his contention he relies on the decision of a Coordinate Bench of this court passed in Sri Ekramul Haque v.
The Union of India & Ors. (Re: WPA 643 of 2026).
5. Despite service none appears on behalf of Election Commission of India.
6. In Ekrarmul Haque (supra) after considering the orders of the Hon'ble Supreme Court dated 20th April, 2026 in Monowara Khatun -versus- The Election Commission of India & Ors. [writ petition(s) (civil) no(s). 496 of 2026 and order dated 24th April, 2026 in Mostari Banu versus The Election Commission of India & Ors. [writ petition(s) (civil) No.(s) 1089 of 2025, a co-ordinate Bench of this Court requested the SIR-
Appellate Tribunal for expeditious disposal of the SIR- appeal filed by the petitioner.
7. In line with the decision passed in Ekramul Haque (supra) the writ petition being WPA 800 of 2026 is disposed of requesting the SIR-Appellate Tribunal to dispose of the SIR-appeal of the petitioner as expeditiously as possible.
8. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.
9. Interim order, if any, stands vacated.
10. All connected applications, if any, stand disposed of.
11. There shall be no order as to costs.
12. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
13. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
