THE COMMISSIONER OF FAMILY WELFARE AND STATE COMMISSION DIRECTOR(NRHM) & ORS.

The petitioner has filed the application praying for a direction upon the respondents to allow the petitioner to participate in the selection process of Asha Karmi in terms of the notification dated 11th October, 2022.

Counsel for the petitioner submits that though the petitioner was eligible and has applied for the said post but the petitioner came to know that instead of considering the case of the petitioner, the respondent authorities have considered the case of other persons and, accordingly, the petitioner has made representation to the authorities for consideration of her case. Counsel for the petitioner submits that the petitioners will be satisfied if the writ petition is disposed of by directing the authorities to consider the representation filed by the petitioner dated 13th January, 2023.

In view of the submissions made by the Counsel for the petitioner, the respondent no. 4,

i.e. the Sub Divisional Officer cum Member Secretary of Selection Committee, Dinhata is directed to consider the representation of the petitioner dated 13th January, 2023 and to dispose of the same by passing a reasoned and speaking order within four weeks from the date of receipt of the copy of this order.

WPA No. 1061/2023 is disposed of.

Affidavit of service filed in Court today by the petitioner is kept with the record.
