Mr. Satyaki Basu Mr. Arijit Sankar Paul ...for the petitioner Mr. Sourab Kar ...for the respondent nos. 3 and 4 Mr. Bikramaditya Ghosh Mr. Pretom Das ...for the State Petitioner retired on superannuation on 31st March, 2020 from the post of Senior Sheristadar under District Judgeship, Jalpaiguri. Petitioner has claimed benefits under the relevant ROPA Rules upon revision of his pay.
Matter was heard previously on 11th July, 2023 when it was brought to the notice of this Court that vide communication dated 26th April, 2023 Senior Accounts Officer of Indian Audit and Accounts Department requested the office of District Judge, Jalpaiguri to make necessary fixation of pay of the petitioner for extending the benefit as claimed by the petitioner.
Today, it has been submitted on behalf of office of District Judge, Jalpaiguri that vide communication dated 10th May, 2023 upon making necessary pay fixation of the petitioner the papers relating to service of petitioner were forwarded to the office of Indian Audit and Accounts Department for taking necessary steps.
The learned advocate representing the Indian Audit and Accounts Department submits on instruction that on 12th July, 2023 Treasury Officer, Jalpaiguri-II was communicated to make necessary payment in favour of the petitioner and in support of the same communication dated 11th July, 2023 of Senior Accounts Officer is placed before this Court which is taken on record.
In view of the steps taken by the concerned authority of Indian Audit and Accounts Department as it appears from the communication dated 11th July, 2023 of the Seniors Accounts Officer of Indian Audit and Accounts Department the Treasury Officer, Jalpaiguri-II is directed to release the amount as sanctioned by the concerned respondent authorities in favour of the petitioner within a period of 4 (four) weeks from the date of communication of this order.
Accordingly, the writ petition stands disposed of.
The learned advocate representing the petitioner is granted leave to amend the cause title of writ petition and add Treasury Officer, Jalpaiguri-II as additional respondent in course of this day. The learned advocate of the petitioner is further directed to serve copy of this writ petition along with the order passed by this Court today upon the Treasury Officer, Jalpaiguri-II within 7 (seven) days from date. The learned advocate representing the office of District Judge, Jalpaiguri is also directed to communicate this order to the concerned Treasury Officer.
There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
