W.P.A. 1080 of 2021 (Nagendra Nath Roy vs. State of West Bengal & Ors.) Mr. Baidurya Ghosal .... For the Petitioner Ms. Chaitali Bhattacharyya .... For the State The grievance of the petitioner is directed against illegal construction and obstruction created by the private respondents. It is submitted on behalf of the petitioner that the private respondents are carrying out illegal construction on the land which belongs to the State.

Ms. Bhattacharyya appearing on behalf of the State respondents submits that there is no merit in the grievance of the petitioner. In any event, she submits that the concerned Executive Engineer being the respondent No. 4 has taken necessary action to ascertain whether any illegal construction is being carried out by the private respondents or any other party in the land belonging to the State.

In view of the submissions made on behalf of the State, W.P.A. 1080 of 2021 is disposed of by directing the concerned Executive Engineer to ensure that no

illegal construction takes place in the subject land belonging to the State by either of the parties. There shall be no order as to costs.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
