Learned advocate appearing for the petitioner submits that the petitioner is in custody since 30.05.2024. It has also been submitted that other accused persons have been released on bail.

Learned advocate appearing for the State, on the other hand, submits that from the house of the petitioner, 380 numbers of SPM-PRX+ capsules and 44 bottles of phensedyl were recovered.

I have considered the order passed in CRM (NDPS) 60 of 2025 wherein bail was granted by referring to the present petitioner as the principal accused and the innocence was claimed by another accused. Having regard to the fact that seizure was from the house of the present petitioner and

charge-sheet was submitted on 31.10.2024 and further there has been no progress in the proceedings since then, I am of the view that at this stage, it would not be fit and proper to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

Learned Special Court is directed to take steps so that within thirty days from the next date of schedule so fixed, the stage of consideration of charges is over. Petitioner would be at liberty to approach this Court after the stage of consideration of charges is over. The application for bail, being CRM (NDPS) 157 of 2025, is, thus, dismissed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
