1. The allegation against the petitioner is of attempting rape upon the victim lady.
2. The C.D. is produced.
3. From the materials therein as well as the submissions made on behalf of the petitioner as well as the State, it is found that the investigation is now completed and charge sheet has also been filed by the Police.
4. In such view of the matter, this Court does not find necessity of custodial interrogation of the petitioner for the purpose of investigation.
5. Therefore, the prayer of bail application is allowed.
6. It is directed that in the event of arrest of the petitioner, the petitioner shall be granted bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Coochbehar. The petitioner shall comply with the condition under Section 482(2) of the BNSS, 2023 and shall cooperate with the investigation in all possible way. He shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever.
7. The petitioner shall further comply with the condition to stay outside the jurisdiction of the concerned Police Station, where the victim lady permanently resides, till the time the evidence of the victim lady is concluded before the learned trial court.
8. C.R.M. (A) 322 of 2026 stands disposed of. (Rai Chattopadhyay, J.)
