1. The petitioner herein prays for anticipatory bail in connection with the Kharibari Police Station Case No.04 of 2026 dated 05.01.2026 under Sections 21(b)/21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. From the FIR and the case diary placed by the State, it appears that the principal accused in the present case, used to hide and conceal the Narcotic Contrabands Substance (Brown Sugar) with assistance of his daughter namely Kanika Barman who used to sell Contraband
Narcotic substance. On further interrogation he stated that he has concealed the narcotic substance at his house for their wrongful gain and his daughter Kanika Barman fled away today.
3. Learned Counsel for the petitioner submits that the quantity in this case is not commercial quantity.
4. On considering the facts, that brown sugar has been seized and also the connection with the petitioner of the principal accused from whose direct possession that is from the house of the accused persons, recovery of the contraband has been made, this Court is of the view, that the nature of offence and the materials on record, does not permit the prayer of the petitioner for anticipatory bail to be allowed.
5. Accordingly the prayer for anticipatory bail in respect of petitioner stands rejected.
6. The application being CRM (A) 324 of 2026 stands, disposed of.
7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities (Shampa Dutt (Paul), J.)
