1. The petitioner herein prayed for anticipatory bail apprehending arrest in connection with Jalpaiguri Women Police Station Case No.47 of 2026, dated 20.04.2026, under Section 8 of POCSO, Act 2012, Corresponding to PTN Case No.59 of 2026 pending before the Court of Learned Additional Sessions Judge, 2nd Court, Jalpaiguri.

On hearing the Learned Counsel for the State who has placed the case diary, the nature of allegations and the materials in the case diary including the statement of the alleged victim under Section 183 Cr.P.C. of the BNSS, wherein the alleged victim has categorically made here statement before the Learned Magistrate and keeping in mind also the fact that the victim has refused medical examination in the present case, this Court is inclined to grant anticipatory bail to the petitioners.

3. Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.5,000/- each with two sureties of Rs.2,500/- each, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioners shall meet the I.O. as and when required till submission of report in final form.

4. The prayer for anticipatory bail of the petitioners is allowed.

5. CRM(A) 335 of 2026 is thus, disposed of.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with requisite formalities.
