SL. 04 26.05.2022 Court No. 05 S Das/AJ In the High Court at Calcutta Circuit Bench at Jalpaiguri Appellate Side CRM (DB) 179 of 2022 (Through Video Conference) In Re: - An application for bail under section 439 of the Code of Criminal Procedure filed on 23.05.2022 in connection with Siliguri Women Police Station Case No. 204 of 2021 dated 25.12.2021 under Sections 370D of the Indian Penal Code read with Sections 3/4/5/6 of the Immoral Traffic (Prevention) Act, 1956.

And In the matter of: Jaleka Begam @ Dipika & Ors. .... Petitioners.

Ms. Madhushri Dutta.

...for the petitioners.

Mr. Aditi Shankar Chakraborty, Ld. AP.P., Mr. Biswarup Roy.

... for the State.

Learned Counsel appearing for the petitioners submits that the petitioners are female inmates and are in custody for a period of 5 months. It is further submitted that the chargesheet has already been submitted and the investigation is concluded against the petitioners. As such, it is prayed that the petitioners be released on bail.

Learned Counsel appearing for the State points out that, as recently as on 4th May, 2022, an earlier bail application of the petitioners was rejected by a co-ordinate Bench of this Court.

Since we do not find any change of circumstances in the meantime, as the charge-sheet was submitted even prior

to the previous refusal, the application for bail, being CRM (DB) 179 of 2022, is dismissed.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
