Hossain Ali@Hossein Ali v. State Of West Bengal And ORS.
Sl No. 78 02.03.2023.
SB-II AGM Calcutta High Court In the Circuit Bench at Jalpaiguri Appellate Jurisdiction WPA 1166 of 2022 Hossain Ali @ Hossein Ali -versus The State of West Bengal & Ors.
Mr. Reshab Kumar, Mr. Sabir Ali, Mr. Prajnadeepta Roy.
... For the petitioner.
Mr. Hirak Barman, Ms. Bedashruti Bose, ... For the State.
The petitioner is aggrieved by the inaction on the part of the police to cause proper investigation in response to the complaints lodged by the petitioner. The issue arises out of some land dispute. The petitioner happens to have been dispossessed from the land which he claims to be his private land. Several complaints were lodged before the police and the petitioner alleges that the police is not taking proper steps to investigate the said complaints.
None appears on behalf of the private respondents. From the report filed by the police, it appears that over the land dispute, there are several complaints and the counter complaints lodged by the parties. Series of proceedings are pending. The petitioner has filed a civil suit seeking recovery of possession of the land. The petitioner's primary concern is that the private respondents have implicated the name of the petitioner's son in several criminal cases.
The Court is of the opinion that the petitioner is required to take necessary steps to contest the
proceeding initiated either against him or his son before the appropriate forum.
The present writ petition is disposed of by directing the Inspector-in-Charge, Kotowali PS to take proper steps so that the pending cases reach its logical conclusion at the earliest.
WPA No. 1166 of 2022 is disposed of.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
