Learned advocate appearing for the petitioners challenges the proceedings of G.R. Case No. 453 of 2024 arising out of Ghoksadanga P.S. Case No. 159 of 2024 dated 04.04.2024. The investigating agency on conclusion of investigation submitted charge-sheet under Sections 498(A)/406/302 of the Indian Penal Code.

Learned advocate appearing for the petitioners challenges the charges which have been incorporated in the report under Sections 173 of the Code of Criminal Procedure. I have considered the documents which have been enclosed along with this revisional application which includes the FIR and the charge-sheet under Section 173 Code of Criminal Procedure. None of the documents under Section 207 of the Code of Criminal Procedure on which the

prosecution proposes to rely in order to substantiate its case are enclosed along with the revisional application and it has been submitted that the same are yet to be supplied to the accused/petitioners.

Having considered the nature of the accusations and that the complete documents are not available with the petitioners, I am not inclined to interfere at this stage since the petitioners would have a scope before the learned Trial Court to canvass all the issues.

Accordingly, petitioners are directed to approach the learned trial court at the stage of consideration of charges. Learned trial court would consider the accusations, assess the complicity of the petitioners on the basis of the materials submitted by the prosecution and thereafter ascertain as to whether all the accused persons are required to face the trial in respect of the charges which have been revealed against them by the prosecution.

With the aforesaid observations, the revisional application being CRR 185 of 2025 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
