The petitioner, an approved Primary Assistant Teacher, by her application dated February 16, 2026 addressed to the Chairman, Cooch Behar District Primary School Council (in short, DPSC) seeks intra district general transfer.

Ms. Bhowal, learned advocate appearing for the District Primary School Council, Cooch Behar, submits that the application seeking general transfer was not submitted by the petitioner through the Utshashree portal and hence cannot be considered.

The petitioner alleges that she could not submit an online application for transfer through the

Utshashree Portal, which is presently suspended by an order dated September 29, 2022, issued by the State. The issue regarding the suspension of the Utshashree Portal and the right of a teacher to apply for transfer was addressed by the Division Bench of this Court in MAT 339 of 2024, dated March 12, 2024 (Apurba Biswas vs. The State of West Bengal & Ors.). In that judgment, the Division Bench directed the concerned authorities to consider the transfer prayer of petitioner notwithstanding the suspension of the Utshashree Portal.

In view of the above, this writ petition is disposed of with a direction upon the Chairperson, the District Primary School Council, Cooch Behar to take a decision regarding the transfer prayer of the petitioner in accordance with law within a period of eight weeks from the date of communication of this order.

Accordingly, WPA 820 of 2026 is disposed of.
