Mr. Nilay Chakraborty, ...For the State Having considered the materials in the Case Diary disclosing prima facie involvement of the petitioner in the alleged transpiration of narcotic substances i.e. ganja, containing 21.5 kg, which is above commercial quantity and in view of the statutory restriction under section 37 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, we are not inclined to grant bail to the petitioners. The application for bail is, thus, rejected.
