1. The petitioner seeks expeditious disposal of an appeal which has been pending before the District Land and Land Reforms Officer, Darjeeling.
2. The High Court under Article 226 of the Constitution of India cannot pass any mandatory direction as the West Bengal Land Reforms Act, 1955 is a notified Act and the jurisdiction vests on the West Bengal Land Reforms and Tenancy Tribunal.
3. However, as an innocuous prayer for expeditious disposal of a pending proceeding has been made, the petitioner is granted liberty to approach the authority with a specific prayer for early disposal of the said
proceeding on an urgent basis and the authority shall consider such prayer and dispose of the matter urgently upon hearing all the parties and strictly in accordance with law.
4. The writ petition is, thus, disposed of.
5. There shall be no order as to costs.
6. Parties are directed to act on the basis of the server copy of this order.
