And In Re: Sultan Islam Petitioners Mr. Hillol Saha Podder Ms. Mousumi Das For the Petitioner Mr. Nilay Chakraborty Mr. Tapan Bhattacharya For the State We have heard the learned Counsel for the parties. We have considered the materials on record, statement of the witness and contemporaneous documents i.e. seizure memorandum show recovery of 275 gms of brown suger from the petitioner which is above the commercial quantity. In view of the statutory restriction under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. The application for bail of the petitioner is rejected. CRM (NDPS) 326 of 2023 is accordingly, disposed of.
