IN THE HIGH COURT AT CALCUTTA

Circuit Bench at Jalpaiguri Criminal Miscellaneous Jurisdiction C.R.M. (NDPS) 164 of 2025 + CRAN 1 of 2025 In Re : An application for relaxation of conditions of bail. And In Re :Tarak Saha & Anr.

... Petitioner.

Mr. Anirban Banerjee ... for the Petitioner.

Mr. Abhijit Sarkar Mr. Chattu Roy ...for the State.

Heard learned counsels for the parties.

The petitioner and another were granted bail by this Court on 9th June, 2025, one of the conditions being to furnish bond to the satisfaction of the learned Special Court wherein one of the sureties would be local with a title deed of property within the jurisdiction of the said learned Court. Learned counsel for the petitioner (2nd petitioner in the bail application) submits that the petitioner is unable to furnish local surety with title deed and still languishing in custody despite being granted bail.

Upon consideration of the submission made on behalf of the parties, the bail condition imposed upon the petitioner on 9th June, 2025 is modified to the extent that the petitioner

shall furnish bond of local surety to the satisfaction of the learned Special Court instead of local surety having property within the jurisdiction of the learned Court. The remaining conditions of bail shall remain unaltered.

The application being CRAN 1 of 2025 is disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
