Learned advocate appearing for the petitioner submits that from three accused persons 60 bottles of cough syrup (100 ml. each) were recovered, aggregating to sum of 6 liters. It has also been submitted that the petitioner along with others were arrested on 25.12.2024 and since then he is in custody. Learned advocate appearing for the State submits that the investigation of the case has been concluded and chargesheet has been submitted, although the FSL report is to be
collected and supplementary charge-sheet is required to be submitted.
The investigating officer is directed to expedite the process of collection of the FSL report.
Petitioner is in custody for a considerable period of time. Having considered that more than five months have passed since he is in custody, I direct that the learned Special Court to release the petitioner on bail after the charges are framed by learned Special Court. The terms and conditions of release on bail would be considered by the learned Special Court at the appropriate stage.
With the aforesaid observations CRM (NDPS) 165 of 2025 is disposed of.
