The grievance of the petitioner is that on 22nd March, 2024 the petitioner has submitted written complaint to the Officer in-charge Asighar Out Post Bhaktinagar Police Station, Jalpaiguri but in spite of receipt of the said complaint, no action has been taken and prayed for appropriate direction upon police for taking appropriate action on the basis of the written complaint dated 22nd March, 2024.
Learned counsel for the State has submitted report of Inspector in-charge Bhaktinagar Police Station wherein it reveals that there are several cases registered in the concerned police station between the parties.
As regards complaint dated 22nd March, 2024, the same was received by the concerned police station on 23rd March, 2024 vide GDE No. 688 dated 23rd March, 2024 and an enquiry was conducted and local witnesses were examined and it was found that a chaos took place over the issue of dumping house waste garbage on the same disputed piece of land by private respondent nos. 5, 6, 7 and 8. Allegation of physical assault and outraging and insulting of female modesty was not established.
Accordingly, enquiry officer has submitted a report under Section 107/116(C) of Code of Criminal Procedure against all the co-respondents dated 23rd March, 2024.
Considered the submission made by the counsel for the respective parties.
Perused the report.
This Court finds that on receipt of the complaint, the police has already inquired in the matter and submitted report under Section 107/116(C) of the Code of Criminal Procedure.
As such, nothing remains in the writ application. Accordingly, writ application is disposed of. (Krishna Rao, J.)
