21.01.2020 RP/ct 1 C.R.M. 1040 of 2019 sl no. 41 Rejected In Re : An application for bail under section 439 of the Code of Criminal Procedure filed on 13.11.2019 in connection with Falakata P.S case no. 463 of 2019 dated 24.08.2018 under sections 365/302/201/34 of Indian Penal Code, 1860.

And In Re : Sambhu Kujor @ Shambhu Kujor ....... applicant Mr. Arijit Ghosh ...... for applicant Mr. Kallol Acharjee Mr. Sourav Ganguly .......for State Mr. Ghosh, learned advocate appears on behalf of applicant and submits, against his client charge sheet has been filed on allegations initially made under section 365 and added sections 302/201/34 of Indian Penal Code. His client has already suffered custody for 144 days. A co-accused had been granted bail. No purpose will be served in continuing custody of his client. Any stringent condition may be imposed. Mr. Acharjee, learned advocate appears on behalf of State and hands up the case diary. He submits, this was a case of kidnapping and thereafter death of the victim.

We have perused the case diary and also seen order dated 26th November, 2019 made by Additional Sessions Judge, enlarging co-accused on bail. The order contains observation that at the time of incident the accused person, enlarged on bail, was in Rajasthan. We are not inclined to grant bail to the applicant. The application is rejected.
