The petitioner appears in person and submits that his application under Section 340 of the Cr.P.C. filed before learned Judicial Magistrate, 1st Court, Kalimpong is not being considered on the pretext that O.C. 3 of 2013 is pending.

I fail to understand as to how this petitioner presumes that the Court proceeding has been interfered. Such cases should come up at the instance of the Court. I also find that the application filed by the petitioner is not in proper form.

Liberty is granted to the petitioner to withdraw the same and file afresh if the need arises in a proper form.

The matter is accordingly disposed of.
