Learned advocate appearing for the petitioner submits that the petitioner was arrested on 20.05.2024 and since then he is in custody. It has also been submitted that the investigation of the case has been concluded and charge-sheet has been submitted before the Jurisdictional Special Court and the next date has been fixed for production and consideration of charges.

Learned advocate appearing for the State on the other hand draws the attention of the Court to the seizure list which

includes 50 bottles of Codeine Phosphate, 23 strips of Pyevon Spasphus Capsules and 131 pcs. of SPM-PRX tablets.. Having considered that the petitioner is in custody for more than a year and the progress has been very slow in respect of Kalchini Police Station case no. 64/2024, I am of the view that the petitioner be released on bail after the evidence of CSW 3 and CSW 4 (independent witnesses) are over. Learned trial Court is directed to ensure that these witnesses are examined by 15th of September, 2025. Learned Special Court would consider the terms and conditions on which the petitioner would be released. With the aforesaid observations CRM (NDPS) No. 170 of 2025 is disposed of.
