Learned advocate for the petitioner submits that the petitioner is in custody since 27th September, 2024, as such, he may be released on bail.
Mr. Biswas, learned advocate appearing for the State, on the other hand, submits that 519 grams of brown sugar were recovered from the petitioner and others. Learned advocate submits that although bail has been
granted to one of the accused but from whom no recovery was effected.
It has also been pointed out that the bail of one of the co-accused was also rejected in CRM (NDPS) 496 of 2024 on or about 17th February, 2025.
Having considered the seizure which has been effected as well as the locus of the petitioner in connection with the seizure, I am not inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is Rejected at this stage.
However, the petitioner would be at liberty to renew his prayer for bail after the stage of consideration of charges is over.
Accordingly, CRM(NDPS) 172 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
