1. The prayer for bail in this case arises out of an order dated 05.03.2025 passed by the Special Court (NDPS Act ), 1st Court, Jalpaiguri in connection with NDPS Case No. 74 of 2024 arising out of Raiganj Police Station Case No. 416 of 2024 dated 30.11.2024 under Sections 20 ( b) (ii)( c)/25/27A/29 of the Narcotics and Psychotropic Substances Act, 1985.

2. The petitioner's case is that he is in custody for last 152 days and there has been no recovery from his possession. It is only because the vehicle in which the contraband was recovered belongs to him that he has been implicated in the present case.

3. The State has placed the case diary from wherein it appears that statutory period in the present has not expired and commercial quantity of Ganja has been

recovered from the joint possession of all the accused persons which includes the present petitioner.

4. Considering the nature of offence alleged, the materials on record and the early stage of investigation, prayer for bail stands rejected.

5. CRM (NDPS) 173 of 2025 stands disposed of.

6. Copy of this order be sent to the learned Trial Court at once.

7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
