1. The petitioners herein pray for bail apprehending arrest in connection with Dinhata P. S. Case No. 159 of 2026 dated 21.03.2026 under Sections 329(3)/115(2)/117(2)/109(1)/74/351(2)/3(5) of the BNS, 2023 and corresponding to G. R. Case No. 174 of 2026 pending before the Learned Sessions Judge, Cooch Behar.
2. On hearing the learned counsels for the parties including the learned counsel for the State who has placed the case diary and on perusal of the injury reports at pages 22 and 26 of the case diary, it appears that the injury is simple in nature and that from the FIR it appears that there was an altercation and previous enmity between the parties regarding some land dispute and as such the incident in the present case occurred.
3. Considering the said facts, the prayer for anticipatory bail is allowed.
4. Accordingly, in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 5,000/- each with two sureties of Rs.2,500/- each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioners shall meet the I. O. as and when required till submission of report in final form.
5. CRM (A) 346 of 2026 is, thus, disposed of.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
