2. The prayer of the petitioner seeking transfer on medical ground is pending consideration at the end of the District Inspector of Schools (S.E.), Jalpaiguri.

3. The report of the BMOH was forwarded to the CMOH for further action.

4. Without going into the merit of the application, the instant writ petition is disposed of by directing the District Inspector of Schools, Secondary Education, Jalpaiguri to take steps to consider the same in accordance with law at the earliest but positively within a period of ninety days from the date of communication of this order.

5. If the prayer of the petitioner is allowed, then option will be provided by the Commission to the petitioner for

selecting the school where the petitioner intends to be transferred.

6. The writ petition stands disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
