Petitioner(s) Mr. Hillol Saha Podder ... for the petitioner(s) Mr. Tapan Bhattacharjee Mr. Chattu Roy ... for the State Learned advocate for the petitioner submits that the petitioner was arrested on 15th September, 2024 and since then he is in custody. Learned advocate submits that the investigation of this case is over, charge-sheet has been submitted and charges have been framed in connection with the instant case, as such, on any stringent condition, the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that a schedule has been fixed by the learned Special Court and contraband(s) so seized include

100.10 grams of brown sugar along with 25 bottles of Phensedyl syrup, as such, the prayer for bail of the petitioner be rejected.

I have considered the submissions of the learned advocate for the petitioner, the State as well as the Case diary from which it reflects that about 15 witnesses have been proposed to be examined by the prosecution from which CSW 4 and 5 are the independent witnesses in the seizure list.

Since the learned trial court has already fixed a schedule, I direct that on the next date so fixed, the learned trial court would fix a date for recording the evidence of CSW 4 and 5 who have been the independent witnesses in the prosecution case.

The prayer for bail of the petitioner, at this stage, is Rejected.

However, the petitioner would be at liberty to approach this court after the evidence of CSW 4 and 5 is over.

Accordingly, CRM(NDPS) 174 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
