In the matter of : Pranabendu Chowdhury ..... petitioner Mr. Jaydeep Kanta Bhowmik ....For the petitioner By the impugned order dated March 5, 2021, the learned Judicial Magistrate, 2nd Court at Siliguri passed an interim order under Section 23(2) of the Protection of Women from Domestic Violence Act, 2005 in favour of the opposite party. Learned Judge fixed May 21, 2021, for service return and appearance of the petitioner.

The order passed, is interim in nature and findings are also prima facie in nature. No interference is called for at this stage since right of precedence of a wife is recognised under the said Act of 2005.

The petitioner may contest the said application filed by the opposite party no. 2 on merit.

The application being CRR 118 of 2021 is disposed of. All parties shall act upon the server copy of this order duly downloaded from the official website of this Court. (Kausik Chanda, J.)
