Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of co-accused and there has been no recovery from his possession. Additionally, it has been submitted that the petitioner is in custody since 29.03.2025. As such, he may be released on bail. Learned advocate appearing for the State submits that although there have been recoveries of 7.32 gms. of heroin and 47 bottles of cough syrup, but the same were from a different accused and not from the present petitioner. The present petitioner, according to the State, has also been implicated on the basis of the statement of the coaccused.

Having regard to the complicity of the petitioner for which he has been implicated in connection with the instant case and the period of detention, I am of the view that further custody of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Court. If on bail, the petitioner shall make himself available on each and every date fixed by the learned Special Court and would cooperate with the learned Special Court for disposal of the case.

The application for bail, being CRM (NDPS) 176 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
