1. The petitioner happens to be the widow of a teacher who joined service on 4th March, 2013 and retired from service on 31st January, 2021. The teacher expired on 9th June, 2022.

2. The widow has filed the writ petition praying for a direction upon the authority for issuance of family pension.

3. It appears that after retirement of the teacher, he never approached the authority for pension as he did not serve for the period qualifying him for receiving pension.

4. After more than three years of the death of the teacher, the widow prays for issuance of family pension in her favour.

5. The Court is of the opinion that as the teacher himself did not seek pension, the claim of the widow for receiving family pension cannot be directed to be considered by the authority.

6. The writ petition fails and is hereby dismissed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
