Rajesh Ghosh And ANR v. The State Of West Bengal
06.12.2024 Sl No.35 srm/Mujahid Calcutta High Court In The Circuit Bench at Jalpaiguri CRAN 1 of 2024 In CRM (A) 396 of 2024 In Re: An application under Section 439(1)(b) of the Code of Criminal Procedure for relaxation of conditions of anticipatory bail.
And In the matter of: Rajesh Ghosh & anr.
... Petitioners Mr. Somraj Paul ... for the petitioners Mr. Nilay Chakraborty, Mr. Biswarup Roy, Mr. Kallol Nag ... for the NIA CRAN 1 of 2024 is an application for extension of time to surrender before the learned court and pray for regular bail in terms of the order dated May 13, 2024. Their Lordships had granted the petitioners four weeks' time to surrender and obtain regular bail.
The petitioners submit that due to some miscommunication between the petitioners and their learned Advocate, they failed to appear before the court within the time stipulated by the learned coordinate Bench.
Under such circumstances, we are inclined to extend the time by allowing the petitioners to surrender before the learned
court and pray for regular bail, positively within two weeks from date.
CRAN 1 of 2024 is accordingly disposed of.
