Affidavit-of-service filed today in Court be kept with the records.

The petitioners pray for disbursal of decreetal amount which is lying with the Chief Medical Officer of Health, Cooch Behar and the Treasury Officer Cooch Behar, Treasury-I.

3.

The petitioners claim to be land owners of the land acquired and utilized by the State and pray that the amount which they are entitled to be disbursed in their favour.

It appears that by a communication dated 13th November, 2024, by the Special Secretary, Heal and Family Welfare Department certain amount has been secured in connection with the acquisition of land at block Mathabhanga under the provision of Act II of 1948.

The instant writ petition is disposed of by directing the respondent no. 6, the Chief Medical Officer of Health, Cooch Behar to take steps for payment of the assessed amount in favour of the respective parties in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order. 6.

The petitioners shall be intimated the formalities to be complied with for the purpose of disbursal of any payment in their favour.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
