Heard the learned Counsel for the petitioner. The notice is stated to be received by the respondent on 31.08.2022 as found from the postal tracking report. Till date none has appeared on behalf of the respondent.

Regard being had to the facts and submissions and taking into consideration the nature of the impugned order passed on October 20, 2021, I feel it expedient in the interest of justice to dispose of the application by directing the learned Additional District Judge, 3rd Court, Darjeeling to dispose of the application of review on merit within a period of one month from the date of receipt of a copy of this order.

It is submitted that the petitioner/husband shall co-operate in disposing of the petition in time.

If the petitioner/husband does not co-operate in any manner, such conduct of the petitioner/husband be recorded in the disposal order on merit.

With the aforesaid order, the revisional application being CO 61 of 2022 is disposed of and the order impugned is set aside.
