Learned advocate appearing for the petitioner submits that the petitioner was earlier granted bail on 13.09.2023. However, because of his absence, the learned Trial Court initially issued warrant of arrest and thereafter issued an order of attachment.
Learned advocate appearing for the State submits that because of the petitioner, there has been delay in trial. I have considered the documents enclosed along with the application for bail which includes the earlier order passed in CRM (NDPS) 712 of 2023 wherein directions were passed that the petitioner should not leave the territorial jurisdiction of the trial court during the entire period of trial and shall attend the trial on each and every date. Having
regard to the fact that the petitioner has ignored the order passed by the High Court and misused the liberty of bail, I am not inclined to release the petitioner on bail considering the fact that the case was registered in the year 2021 and till date, out of 16 witnesses, only one witness has been examined. As such, the prayer for bail of the petitioner is rejected.
Learned Trial Court would take steps so that at least a schedule of three dates is fixed once in a month so that trial of the case can be taken to its logical conclusion within a reasonable period of time.
The application for bail, being CRM (NDPS) 180 of 2025, is, thus, dismissed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
