Affidavit of service filed on behalf of the petitioner is taken on record.
It is contended on behalf of the petitioner that pursuant to a tender issued by the respondent authorities for construction of cross drain with H.P. at Lookshan Zilla Parishad Road to Kuchidiana River and Gravel Road from Lookshan G.P. to NH.31 under Lookshan G.P. Nagrakata development block under Nagrakata Panchayat Samity, the petitioner was issued work order and completed construction work within due time. Out of the entire due amount payable to the petitioner, the concerned authority paid Rs. 1,00,000/- only and the remaining amount is still due.
The petitioner submitted a representation before the authority for clearance of his dues which is yet to be disposed of. The petitioner prays for a direction upon the
authority to consider his representation and clear the dues at the earliest.
Upon consideration of the submissions made on behalf of the parties and material on record, the writ petition is disposed of directing the 5th respondent herein to consider and dispose of the representation submitted by the petitioner, after affording reasonable opportunity of hearing to the petitioner and the private respondents within one month from the date of communication of this order, in accordance with law.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition being WPA 1263 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
