Copies of the writ petition have been already served on Learned State Counsel.

Ms. Chanda, learned Counsel, appears for the petitioner and submits that the petitioner applied for a contract carriage permit before the Regional Transport Authority (RTA),

Alipurduar, which has been still kept pending. The petitioner is aggrieved by such pendency without consideration. Learned State Counsel submits that in view of the fact that the application for the contract carriage permit is claimed to be still pending, the same may be considered in accordance with law.

Having regard to the above discussion, this writ petition is not detained further.

The RTA, Alipurduar is permitted to consider the pending application of the petitioner for a contract carriage permit at its available Board Meeting but, not later than a period of 12(twelve) weeks from the date of communication of this order, and strictly in accordance with law. The reasoned order of the RTA, Alipurduar shall be then communicated to the petitioner.

WP No. 21332 (W) of 2019 stands accordingly disposed of.

Since affidavits are not invited, allegations made in the writ petition are deemed not to have been admitted. The petitioner is permitted to amend the name of the District in the Presentation Form.

Affidavit of Service filed in Court today be retained with the record.

Urgent Photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
