Petitioner is aggrieved by the fact that there has been non-compliance of the statutory mandates of the NDPS Act and in spite of the same the petitioner has been detained in custody for about 143 days.

Learned advocate submits that even the house which is claimed by the investigating agency do not belong to the petitioner and the G.D. Entry number which is shown in the inspection memo and the formal FIR are two different General Diary Entries.

Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the different types of contraband which were seized from the house belonging to the petitioner. According to the State the investigation of the case is still in progress. I have considered the submissions of the learned advocates appearing for the petitioner as well as for the State and having regard to the fact that the investigation of the case is still in progress and the nature of the diverse contraband so recovered, I am of the view that at this stage the petitioner's prayer for bail cannot be acceded to. Consequently, CRM (NDPS) 186 of 2025 is dismissed.
