09.06.2023 SL No.50 Court No.1 (gc) (Rejected) Circuit Bench of Calcutta High Court At Jalpaiguri CRM (A) 306 of 2023 In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure filed in connection with Madarihat Police Station Case No.193 of 2022, dated 16.11.2022 under Sections 21(c)/25/29 of the NDPS Act.

And In the matter of : Rabiul Islam - Petitioners.

Mr. Sudip Guha ... For the Petitioner.

Mr. Aditi Shankar Chakraborty, Ld. A.P.P.

Mr. Subhashis Mishra, ... For the State.

The learned Counsel for the petitioner submits that there is an inconsistency between the FIR and the seizure list and he has been falsely implicated.

The learned Counsel for the prosecution submits that huge quantities of narcotic substances have been recovered from the house of the petitioner.

Considering the memorandum of charges and the seizure list showing contraband articles recovered from the house of the petitioner, at this stage, we are not inclined to grant anticipatory bail to the petitioner.

Accordingly, the application for anticipatory bail is rejected and disposed of.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Raja Basu Chowdhury, J.) (Soumen Sen, J.)
